Terms and Conditions of the www.nextmusic.pl website
effective from 1 December 2025
GENERAL PROVISIONS
- These Terms and Conditions set out the rules for the free use of the website called "nextmusic.pl" by individual Users.
- The owner of the nextmusic.pl website is Next Film, a limited liability company based in Warsaw.
- By using the Website, the User agrees to the terms and conditions set out in these Terms and Conditions.
- The Terms and Conditions are available free of charge on the Website in a form that allows them to be downloaded, saved and printed. At the User's request sent to the e-mail address: kontakt@nextmusic.pl, the Terms and Conditions may also be sent free of charge by e-mail in electronic form to the e-mail address provided by the User.
- The personal data of Users using the services available through the Website are processed in accordance with the rules described in the Privacy Policy, available in the tab linked in the footer of the Website.
DEFINITIONS
- Next Film – Next Film Sp. z o.o. with its registered office in Warsaw at ul. Czerska 8/10 (00-732) Warsaw, registered in the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, under KRS number: 0000432663, NIP: 725 20 61 849 – owner of the Website and Service Provider.
- Terms and Conditions – these terms and conditions.
- Website – the website available at www.nextmusic.pl.
- Electronic Service – a service provided electronically by the Service Provider to the Service Recipient via the Website, i.e. a service provided without the simultaneous presence of the parties (remotely), through the transfer of data at the individual request of the Service Recipient, sent and received using electronic processing devices.
- Service Recipient – a User who uses or intends to use the electronic Services provided via the Website.
- Service Provider – Next Film.
- User – any natural person visiting the Website.
ELECTRONIC SERVICES PROVIDED ON THE WEBSITE
- Electronic services provided through the Website:
- access to the Website, within which the Service Recipient may view the content available on the Website;
- internet communication service with the Service Provider via a contact form, within which the Service Recipient may ask questions or provide information to the Service Provider.
- The contract for the provision of access to the Website is concluded when the User effectively enters the Website's URL in the browser window of their device or when the User uses a redirect leading to the Website (i.e. when they enter the Website).
- The contract for the provision of access to the Website is terminated when the User leaves the Website.
- The contract for the provision of internet communication services with the Service Provider is concluded when the User performs all of the following actions:
- entering the contact form via the "Contact us" button available in the footer of the Website, or via the "Fill in the form" button available on each subpage, or entering the contact form via the "Contact" tab,
- providing an email address by the User,
- filling in the contact form with the content that the User wishes to send to the Service Provider,
- clicking the "Send" button.
- The contract for the provision of internet communication services with the Service Provider is terminated when the Service Provider responds by email to the message sent by the User via the contact form.
- The Service Recipient may terminate any agreement for the provision of electronic services described in the Terms and Conditions at any time, without giving a reason and with immediate effect.
- When using the Internet communication service with the Service Provider, the User is obliged to provide true and correct data necessary for the performance of the Electronic Service.
RULES FOR USING THE WEBSITE
- Use of the Website is possible provided that the ICT system used by the User meets the following minimum technical requirements:
- a device connected to the Internet with an installed and operational web browser supporting HTML5,
- enabling cookies and javascript in the web browser.
- No fees are charged or collected for using the Website.
- The User is not able to post any content on the Website.
- The User is obliged to use the Website in accordance with the law and good manners, taking into account the personal rights and intellectual property rights of the Service Provider or third parties.
- The User is prohibited from taking any actions that would affect the proper functioning of the Website, in particular, any interference with the content posted on the Website is prohibited.
- In the event of reservations regarding the operation of the Website, the User may submit a complaint by:

- sending traditional correspondence to the following address:

- All complaints, including those related to the provision of electronic services, will be considered immediately, within no more than 14 calendar days from the date of submission. The complainant will receive a response in the form of an e-mail sent to the e-mail address from which the complaint was sent.
FINAL PROVISIONS
- The Terms and Conditions shall enter into force on 1 December 2025.
- Next Film is entitled to unilaterally amend the Terms and Conditions to the extent that has not been individually agreed with the User on the basis of a justified reason. The following circumstances shall be considered justified reasons:
- a change in the provisions of law generally applicable in the Republic of Poland to the extent that such a change affects the content of the Terms and Conditions or imposes an obligation on Next Film to modify the content of the Terms and Conditions;
- the issuance by public administration bodies, including in particular the
President of the Office of Competition and Consumer Protection, of decisions, recommendations, obligations or acts of a similar nature to the extent that the above-mentioned administrative acts affect the content of the Terms and Conditions or impose an obligation on Next Film to modify the content of the Terms and Conditions; - a change or introduction of an interpretation of the law based on final judgments of common courts in Poland, administrative courts, the Supreme Court, the Supreme Administrative Court or the Court of Justice of the European Union to the extent that the above-mentioned case law affects the content of the Terms and Conditions or imposes an obligation on the Service Provider to modify the content of the Terms and Conditions;
- introduction by Next Film of new functionalities of the Website or modification of their current scope or removal of functionalities – modification of the content of the Terms and Conditions is permissible to the extent that it concerns such new functionalities, their modification or removal;
- organisational changes in the Agora S.A. capital group resulting in a change of the company within the related entities of Agora S.A. within the meaning of the Accounting Act of 29 September 1994, which operates the Website or any part thereof;
- The Terms and Conditions require supplementation, clarification or modification for the sake of greater transparency of their provisions for Users – changes to the content of the Terms and Conditions are permissible to the extent that they allow for greater transparency of their provisions;
- counteracting unforeseen and direct threats related to the protection of the Website, electronic services and Users against fraud, malware, spam, personal data breaches or other cybersecurity threats – changes to the Terms and Conditions are permissible to the extent that they allow for greater cybersecurity.
Amendments to the Terms and Conditions pursuant to this point shall only be made in connection with the reason that gave rise to the amendment and to the extent necessary to implement the amendment.
- Next Film shall inform the User of any changes to the Terms and Conditions by publishing the following on the Website:
- the content of the planned amendment to the Terms and Conditions,
- the reasons and justifications for introducing the change to the Terms and Conditions,
- the date of entry into force of the amendment to the Terms and Conditions,
- the uniform content of the Terms and Conditions after the changes.
- The amendment to the Terms and Conditions does not apply to contracts for the provision of electronic services concluded before the date of entry into force of the amendment to the Terms and Conditions. In the case of such contracts, the provisions of the Terms and Conditions in force on the date of the User's expression of will to conclude a contract for the provision of electronic services shall apply.
- In matters not covered by the Regulations, the relevant provisions of law shall apply, in particular the Civil Code, the Act of 18 July 2002 on the provision of electronic services, and the Act of 30 May 2014 on consumer rights protection.
- For the avoidance of doubt, it is assumed that none of the provisions of the Terms and Conditions limit the consumer's rights under the provisions of law generally applicable in the territory of the Republic of Poland. If a provision of this nature is found to exist, the provisions of applicable law shall apply without exception.
- Any disputes arising from the Terms and Conditions that cannot be resolved amicably between the User and Next Film shall be settled by a common court of law with jurisdiction over the registered office of Next Film.
